Exciting developments in the H1B visa lottery system have emerged, promising a more transparent and fraud-resistant process. The U.S. Citizenship and Immigration Services (USCIS) has introduced significant changes aimed at curbing misuse and ensuring a fair chance for all applicants.
Key Changes and Their Implications:
One Application Per Candidate: In a move to eliminate fraud, the USCIS has revised its policy so that multiple H1B applications for a single candidate, regardless of the number of companies sponsoring, will not increase their chances of selection. This change, effective immediately, bases a candidate's lottery chance solely on their unique passport number, eliminating any advantage from multiple filings.
New Registration Platform: Beginning February 28th, companies can create accounts on a new registration platform, distinct from the myUSCIS accounts used in previous years. This new system is designed to streamline the process, making it more user-friendly for both companies and their legal representatives.
Registration Window: The crucial window for H1B registration opens on March 6th, 2024, and closes on March 22nd. Applicants and their employers are encouraged to prepare their documents and finalize their submissions within this timeframe. It's important to note that submissions can be made at any point during this period without affecting the chance of selection.
Application Fee: The registration fee remains at $10 for this cycle, despite proposals to increase it. However, selected applicants should be prepared for higher filing fees for the actual petition, including a new $600 surcharge, beginning April 1st.
Selection Process: The lottery remains unbiased towards the number of entries per candidate. If selected, all sponsoring companies will be notified, but the candidate must choose only one offer to proceed with.
Modernization and Fraud Prevention:
The USCIS's modernized approach includes flexibility in selecting the visa start date, catering to candidates' specific situations, such as those on OPT. Moreover, stringent measures are in place to revoke petitions based on fraudulent or misrepresented applications, underscoring the importance of genuine job offers.
Lottery Odds and Masters Cap:
The lottery system retains its structure, first considering all applicants for the regular cap before moving unselected master's degree holders to their dedicated pool, enhancing their chances. This method remains unchanged, ensuring equity and maximizing opportunities for those with advanced degrees from U.S. institutions.
Filing Best Practices:
Candidates are advised against engaging with multiple filings from dubious sources. Genuine job offers from reputable companies remain the cornerstone of a successful H1B application. With the USCIS's commitment to transparency and fairness, the process has been streamlined for both employers and potential employees, focusing on merit and genuine opportunities.

#SettleWiseStance – The integrity of the H1B visa lottery system has been challenged by individuals submitting multiple applications without genuine job offers, exploiting loopholes for personal gain. This unethical practice undermines the fairness of the system, diminishing the chances of those who adhere to the rules and submit a single, honest application. The USCIS has identified numerous cases as fraud, imposing lifetime bans on entry to the USA for such offenders. However, it's important to clarify that having legitimate job offers from more than one employer does allow for the submission of multiple applications. This is entirely within the bounds of law and ethics. But applicants should be aware that this doesn't increase their likelihood of selection in the lottery; each candidate, regardless of the number of submissions, is considered as a single entity. This measure ensures equity in the process, safeguarding the interests of all applicants, especially those who play by the rules.
